September 24, 2019 – Municipality / City Cannabis Regulation Updates

Oxnard, CA Update

  • The ordinance would allow dispensaries in the Downtown Core, Downtown General and Downtown Edge zoning districts through approval of a Special Use Permit.
  • The Commission would like to recommend prohibiting flavored vaporized products and child friendly edible products- however it is up to the City Attorney to draft this language so that it does not overstep the State’s regulations on these issues.
  • A 600 foot buffer zone is imposed for residential zoned areas (except for mixed uses-this exemption considers the downtown areas in amendment 1).


Santa Rosa, CA Update

  • Staff will also recommend to the Planning Commission and City Council to rezone 33 additional parcels along the east side of Petaluma Hill Road and Santa Rosa Avenue corridor between Colgan Avenue and Bennett Valley Road.
  • Approved expansion of building from 491 sq ft → 3297 sq ft
  • Allowed for Retail dispensary in Plaza Shopping center

Thousand Oaks, CA Update

  • Another motion was made to direct staff to make changes that would allow deliveries within the city, eliminate the 24-hour appointment and amend the hours of operation for storefronts and delivery from 8 AM to 9 PM. This motion was also carried. Staff will bring said changes before Council during a future meeting. Make a phone call to city for dates.

Sacramento, CA Update

  • Allow volatile manufacturing in the City
  • Increase the annual gross receipts limit from $100,000 to $500,000 for small manufacturers under section 17.228.900
  • Approving the concept of a 45-day temporary moratorium on all types of hemp cultivation in the city
  • Forwarding the matter and any appropriate ordinance to enact the moratorium directly to the City Council for consideration.

Colton, CA Update

  • Allow the following uses on sites within Marijuana Candidate Sites” (MCS) Overlay zone: indoor cultivation, manufacturing, testing, distribution, a microbusiness of medicinal and adult-use marijuana and marijuana products, and the ancillary transportation and delivery of marijuana or marijuana products.
  • Amend the Zoning Code to remove all current regulations and standards pertaining to marijuana cultivation and related business permitting (except for the permitted uses tables) and incorporate these into the Business License chapter (new chapter 5.54)
  • Amend the Zoning map to expand the “Marijuana Candidate Sites” (MCS) Overlay zone to include the area around Key St./Pellissier Rd. and Placentia Ln along the south city limits of Colton- in addition to existing areas.


City of Davis Update

  • Request for Proposals to Provide Audits and Compliance Reviews of Cannabis Businesses Operating in the City of Davis
  • Department City Manager’s Office, Finance

    Start Date September 13, 2019 2:02 pm –  Close Date October 01, 2019 5:00 pm. Proposals Due By 5:00 p.m. on Tuesday, October 1, 2019.
  • The City of Davis is interested in securing the services of a third-party vendor to conduct one annual financial audit and up to two compliance reviews of all of Davis’s permitted cannabis businesses. Measure C, as well as the City’s municipal code, Chapter 21 Marijuana/Cannabis Business Permits, Article 04.160 Retail Cannabis Business/Maintenance of records allows the City or its designated agents to conduct periodic audits and inspections of the cannabis businesses’ books, logs and financial and operational records. The award resulting from this RFP shall be a contract for a three year period, with the option to extend the agreement for up to two (2) additional one year contract periods, at the City’s sole discretion.


Humboldt County Update

  • Pre-existing cannabis cultivators can still apply for county permits.
  • The Humboldt County Planning and Building Department wants to remind cannabis cultivators that “pre-existing” cannabis operations (those existing prior to Dec. 31, 2015) can still apply for county permits to become legal.
  • The window is quickly closing for pre-existing cannabis cultivation sites to apply for permits to come into compliance, and will only remain open through the end of 2019. Applications submitted for pre-existing cultivation between now and the end of this year may qualify for permitting at 50% of the documented existing cultivation area. No new applications for pre-existing cultivation sites will be accepted after Dec. 31, 2019. Town of Fairfax Update

  • Adopted two ordinances, which take effect October 4, 2019, to address commercial cannabis:
    • An ordinance establishing zoning standards and restrictions for certain commercial cannabis uses and cannabis cultivation for personal use. The Town only allows adult-use delivery-only retail businesses and continues to allow medical storefront and delivery operations. The ordinance would establish a maximum of two commercial cannabis businesses at any one time in town. A business can be a combination of any of the allowed uses.
    • An ordinance regulating commercial cannabis businesses which establishes the local cannabis business permit approval process.
  •  Adopted an ordinance amending local smoking regulations to prohibit the sale of favored tobacco products to include menthol-favored tobacco, all cigar packaging sizes, and pipe/chewing tobacco. This ordinance takes effect September 1, 2020.
  • Introduced an ordinance to establish time limits for incomplete applications and project entitlement approvals. Please note that the introduction of an ordinance is the first of two public meetings required for the Council to adopt an ordinance.
  • Introduced an ordinance regulating single-use foodware to require businesses to use compostable or reusable materials for take-out food.


City of Novato Update

  • Novato Planning Commission to consider licensing and permitting regulations
  • The Planning Commission is scheduled to hold a public hearing on September 23, 2019 at 7pm to consider licensing and permitting regulations for commercial cannabis activities including indoor cultivation, manufacturing, distribution, and sales of cannabis and cannabis-related products. The meeting will be held at City Hall, 901 Sherman Avenue, Novato.
