On November 8, 2016, Nevada voters passed the Regulation and Taxation of Marijuana Act (Ballot Question 2) to allow adult-use cannabis in the state.  The states Cannabis Compliance Board quickly passed state regulations and adult use sales began on January 1st, 2018. 

Most recently, the state passed regulations allowing cannabis consumption lounges, opening up an exciting new license type which is especially enticing in Las Vegas, one of the largest tourist destinations in the world.

Nevada Cannabis Overview: The Cannabis Control Authority was recently formed on July 1st, 2021. The CCA will adopt final regulations for zoning and application processes in 2022 at the earliest with a target date of January 1st, 2024 for retail sales to begin in the state. Applications for consumption lounges are expected to begin in the winter-spring seasons of 2022.

Distance Requirements: Marijuana establishments may not be located within 1,000 feet of a public or private school for grades pre-K through 12 or within 300 feet of a community facility and 1,500 feet of an establishment that holds a non-restricted gaming license.

License Types and Caps:

Nevada is not currently accepting applications for cannabis businesses. The application window for the new cannabis consumption lounge licenses are expected to open in the winter or spring of 2022.

County Retail caps:

Eighty licenses already issued in a county with a population greater than 700,000;
Twenty licenses already issued in a county with a population that is less than 700,000 but more than 100,000;
Four licenses already issued in a county with a population that is less than 100,000 but more than 55,000;
Two licenses already issued in a county with a population that is less than 55,000;

 

Tax Rate:

Adult use retail: Purchases are subject to a 10% cannabis excise tax, pluse the 4.6% statewide sales tax. Out the door, expect a total of roughly 15% added to your purchase for taxes.

Medical marijuana: Purchases are subject only to the 4.6% statewide sales tax.

Wholesale: There is a 15% marijuana excise tax imposed on wholesale sales and transfers.
